This document outlines the Terms and Conditions (T&Cs) for Sunny Art Centre's services and products, including Art Courses, Art & Design Portfolio Preparation Courses, Online Art Courses, and other products listed online. Please refer to the relevant sections based on your specific purchase or enrolment.

This agreement (the “Arts Portfolio Course Service Agreement”) was made on “27.09.2024” by and between SAC “Sunny Art Centre” and the customer who made payment online. In consideration of the mutual agreement made herein, both parties agree as follows:

1. General T&Cs and Cancellation Policy

1.1. Cancellation Notice
We require a minimum of 48 hours’ notice for any cancellations or rescheduling of lessons. No cancellations or rescheduling will be accepted within this period, and no exceptions will be made.

1.2. Rescheduling Procedure
To cancel or reschedule a class, log in to your account via our online platform and make the necessary amendments. Cancellations and rescheduling requests via phone or email are not accepted.

1.3. Credit Management
Expired credits cannot be extended. If you purchase a new package, current, active credits  will be transferred to the new package, with the new expiry date applied. If purchased after the credits have expired, these cannot be transferred to the new expiry date. 

1.4. Sharing of Packages
You may share your package of lessons with family members. One lesson will be deducted from your package for every additional person attending a lesson. This applies to all packages, including one-to-one lessons and short courses.

1.5. Enrolment Requirements
If you purchase a package of lessons, you must attend your first lesson within 40 days from the date of purchase. If you miss this deadline, your account will be automatically activated, and you will be enrolled.

1.6. Refund Eligibility
You may request a refund within 14 days from the date of purchase if you have not yet enrolled, subject to a 15% administrative fee. After 14 days, no refunds will be issued.

1.7. After completing your enrollment or booked your first lesson, you will not be able to request a refund.

1.8. Punctuality
Students are required to be punctual for their lessons. If you arrive early, please wait until the designated start time. If you arrive late, you must adhere to the scheduled end time and leave promptly when the lesson concludes.

2. Refunds and Expiry Dates

2.1. Refunds for Expired Lessons
Refunds for lessons that have expired and were not used within their expiry date will not be issued under any circumstances.

2.2. Tuition Fees and Payment Obligations
It is your responsibility to ensure that all tuition, deposits, and other fees are paid when due. Failure to do so may result in account suspension or other consequences.

2.3. No Substitution of Packages
You may not replace or substitute your package of classes with other same-value products.

2.4. Non-Refundable Tuition Fees
If a student withdraws from a course for any reason, the tuition fee will not be refundable.

2.5. Material Requirements
Students are required to bring their own materials to use during classes. Materials are also available for purchase at the studio.

2.6. Consequences of Unpaid Fees
If there is any outstanding debt to the Centre, we reserve the right to:

  • Suspend or exclude the student from the course.
  • Withhold assessment results, certificates, or awards.
  • Refuse to register the student for any future courses or examinations.

2.7. Debt Recovery
If the debt remains unpaid, we may take legal action for recovery, and the student will be responsible for all associated costs, including:

  • Legal costs and expenses
  • Administrative fees
  • Collection costs incurred by the Centre or a third-party agency

2.8. Refund Conditions
For eligible refunds, the original transaction receipt must be presented. A 15% administrative fee will be applied to all eligible refunds.

3. Health and Safety

3.1. Material Safety
All staff and students must be aware of the potential hazards of materials used in workshops. Follow the manufacturer's instructions, including guidelines for use, storage, and required personal protective equipment.

3.2. Safety Precautions
Health and safety precautions will be reviewed with students before any activity.

  • No Asbestos, Lead-based Glazes, or Benzene will be used in workshops.
  • All spray painting must be done outdoors or in a properly ventilated area.

3.3. Classroom Safety
Aisles must be kept clear at all times to ensure quick evacuation in case of an emergency. Reduce the storage of paper goods to minimize fire hazards.

3.4. Sharp and Electrical Tools
Knives and other sharp instruments should be maintained, handled, and stored safely. All electrical appliances must be turned off when not in use. Heated tools should be allowed to cool down in a safe place before storage.

4. Art Materials – Refunds and Fees

4.1. Non-Refundable Art Materials
Art materials purchased via our online website are non-refundable once purchased.

4.2. Exchanges for Unused Items
Exchanges for unused Art Materials will only be considered if exchanged for items of equal or higher value. If exchanging for a more expensive item, the price difference must be paid. Cashback or partial refunds for exchanges are not available.

4.3. In-Store Purchase Conditions
Art Materials purchased in-store are non-refundable if they have been opened or used.

5. Other General Conditions

5.1. Binding Agreement
By accepting this agreement, you enter into a legally binding contract and must adhere to all clauses herein.

5.2. Right to Stay in the UK
You declare that you hold the right to stay in the UK for the entire duration of your course.

5.3. Criminal Record Declaration
You confirm that you do not have a criminal record or history of offenses at the time of signing this agreement.

5.4. Building and Maintenance Work
The Centre reserves the right to conduct building and maintenance work at times that may cause minimal disturbance. However, we will strive to minimize the impact on students.

6. Safeguarding Policy

The Sunny Art Centre is committed to safeguarding the security, privacy, and dignity of all students, particularly children and young people who attend our courses. We provide a safe and inclusive learning environment for everyone, irrespective of age, disability, gender, race, religion, or sexual orientation.

6.1. Commitment to Safety
We have a responsibility to protect the welfare of all students and promote a safe learning environment. This policy works alongside our Code of Conduct for staff.

6.2. Principles of Safeguarding

1. Introduction
These Terms and Conditions ("T&Cs") govern the use of Sunny Art Centre’s Online Art Courses ("Courses"), which are accessible through our website https://sunnyartcentre.com ("Website"). By enrolling in our Courses, you agree to be bound by these T&Cs.

2. Study

The Arts Portfolio Preparation student will receive one-to-one tuition to help prepare their portfolio for applications to colleges, universities, or scholarships to study Arts, or who are preparing Arts A level or GCSE portfolios. This will involve following a bespoke study plan to assist in the production of the student’s portfolio. The student is expected to complete tasks according to the ‘Portfolio Course Student Guideline’ in a timely manner under the tutor’s instruction to enhance the students’ ability to complete his or her portfolio application.

3. Enrolment

If you have purchased a package of lessons, you must enrol by attending your first lesson within 40-days from the date of purchase. If you miss this deadline, your account will automatically be activated and you will automatically be enrolled. You are eligible to request a refund within 14 days from the date of purchase if you have not yet enrolled, but a 15% administrative fee will be charged. After 14 days, you will NOT be able to request a refund.

After completing your enrollment you will not be able to request a refund.

4. Expiry

All the lessons you purchased must be used before they expire. Your booking will not be accepted once they are expired, and there is no exception.

Refunds for lessons that expired and were not used within their expiry date cannot be issued.

5. Portfolio Progress Rate Declaration

SAC will provide the agreed services and support the student to produce a portfolio to the best of their ability. However, SAC cannot guarantee the completion of the portfolio within the duration of the hire by the student. As the progress rate of the portfolio can be affected by factors outside of SAC’s control, SAC will be responsible for delivering the agreed tuition within the projected timeline, and the student will be responsible for the completion of the work making up the portfolio.

6. Application Success Rate Declaration

SAC will provide the agreed services and support the student to produce

a portfolio to the best of their ability. However, the success rate of the student’s overall application can be affected by components outside of, and factors unrelated to, the portfolio produced with SAC, therefore SAC cannot guarantee the success rate of the student’s application.

7. Sickness

If the student is sick or injured and cannot attend the lessons, the student must inform SAC and the Tutor no later than 6 hours before his or her agreed start time or as soon as reasonably practicable, unless an extreme emergency does not allow for this. The student must provide a reason for his or her absence, and communicate with his or her Tutor and SAC on rescheduling. As SAC operates with a 48-hour cancellation policy, SAC cannot guarantee that any lesson credit/credits cancelled within a 48 hours notice period due to sickness will be returned to the students account.

8. No Show/Late Arrival

If students do not arrive on time without prior notice, tutors can choose to leave after a 30 min wait from the scheduled lesson start time, and students will be notified. The credit will be deducted from the student’s package. In the event the student arrives late (either less than 30 min or if over 30 min but the tutor chose to stay until student’s arrival), the lesson time will remain as originally scheduled and students will only have the remainder of the lesson duration and not a full 2 hour session from the time of their arrival.

Tutors will give written notice to notify SAC of such events, and confirm if the student joined the lesson or if the tutor terminated their wait time after 30 min to avoid any dispute.

If lessons began earlier than the scheduled lesson time (under mutual consent between tutor and student), the lesson duration will remain at 2 hours and will terminate early to reflect the early start.

9. Cancellations

All cancellations must be made a minimum 48 hours prior to the scheduled lesson start time. It is the student’s responsibility to notify their tutor and SAC immediately, any cancellations made after the 48 hour window will result in credit being deducted.

10. Misconduct

We strive to foster an inclusive environment where everyone feels valued, respected and supported regardless of their background. Discriminative views have no place at SAC and any abusive behaviour towards staff members will not be tolerated. SAC reserves the right to refuse serving the student.

11. SAC’s Rights

In case of strong disagreement between tutor and student which can not be resolved, SAC reserves the right to step in and make any adjustments necessary, including replacing the tutor.

12. Acceptance of Terms

By signing below, both SAC and the student agree they have read, understood, and are considered legally bonded to these terms.

1. Introduction

2. Enrolment and Account Creation

5. Payments and Fees

5.1. All fees are displayed in GBP and must be paid in full prior to accessing the Courses.
5.2. Prices may vary based on device or location due to third-party policies.
5.3. If a payment method fails, you agree to settle the outstanding balance within 14 days of receiving our notification.

6. Refund Policy

6.1. You may request a refund within 14 days of purchase by contacting us at info@sunnyartcentre.com. Please include "Refund Request" in the subject line and provide your order number.
6.2. Refunds are not available after 14 days from the date of purchase.
6.3. Partial refunds are not provided, and refunds for purchases through third-party platforms (e.g., Apple App Store) must be handled through those platforms directly.

7. User-Generated Content

7.1. Users may submit content for review, such as artwork or questions for our tutors.
7.2. Abusive, unlawful, or plagiarized content is not permitted. We reserve the right to terminate accounts violating these terms without refund.
7.3. By submitting content, you grant us a worldwide, royalty-free license to use, edit, and distribute your content for educational and marketing purposes.

8. Art Materials

8.1. Optional Art Materials Packs are available for purchase but are not mandatory to access Courses.
8.2. Refunds for unopened Art Materials Packs can be requested within 14 days of purchase.
8.3. We are not responsible for the safety or use of materials produced by third-party manufacturers.

9. Limitation of Liability

We strive to provide high-quality content and a seamless learning experience. However, we are not liable for any technical issues, interruptions, or damages resulting from the use of our Courses, to the fullest extent permissible by law.

10. Governing Law

These T&Cs are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts in England and Wales.

11. Changes to the T&Cs

We reserve the right to modify these T&Cs at any time. Any updates will be posted on this page, and continued use of our Courses constitutes acceptance of the revised terms.
